Terms of Service

These Terms of Service ("Terms") govern access to and use of the ITMEase platform ("Service"), operated by ITMEase ("we," "us"). By creating a workspace, accepting an invitation, or using the Service, you agree to these Terms on behalf of yourself and, where applicable, the organization you represent ("Customer").
1. The Service
ITMEase is workflow software for inspection, testing, and maintenance contractors: scheduling, field data collection, report generation, deficiency tracking, and related tools. The Service is provided on a subscription basis per the plan selected in your workspace settings.
2. ITMEase is a productivity tool, not a compliance authority
The Service does not provide regulatory, legal, or engineering advice, and nothing in the Service constitutes a determination that any inspection, template, form, or report satisfies any code, standard, or law (including, without limitation, NFPA, ASME, or ICC standards, or any federal, state, or local requirement). Template content, question banks, and reference materials supplied with the Service are editorial starting points — they may be incomplete, may not reflect the code editions adopted in your jurisdiction, and are fully editable by you. Code citations identify sources; they are not representations of completeness or applicability.
3. Customer responsibility for regulatory compliance
The Customer — not ITMEase — is solely responsible for: (a) the qualifications and certifications of its personnel; (b) the adequacy, accuracy, and completeness of every inspection performed and every report issued; (c) compliance with all codes, standards, and laws applicable to its work; and (d) the content of templates and deficiency rules used in its workspace, including any it adopts from the supplied starting points.
4. Accounts and acceptable use
You are responsible for safeguarding credentials and for all activity under your workspace. You may not: misuse the Service to violate law; attempt to access another customer's data; probe, disable, or overload the Service; or resell access without our written agreement. We may suspend accounts that present a security or abuse risk.
5. Customer data
You retain all rights to the data you and your team put into the Service (customer records, inspection responses, photos, reports). You grant us the limited rights needed to operate the Service — storage, processing, backup, and display back to your authorized users. Our handling of personal data is described in the Privacy Policy.
6. Subscriptions, trials, and termination
Paid plans bill in advance through our payment processor (Stripe). Trials convert to read-only access when they expire, and unpaid subscriptions may be suspended after the dunning window. After cancellation or non-payment, workspace data is retained for a limited offboarding window (30 days) during which you may request an export; after that window it may be permanently deleted. You may cancel at any time from workspace billing settings; fees already paid are non-refundable except where required by law.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, AND OUR AGGREGATE LIABILITY ARISING OUT OF THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY THE CUSTOMER IN THE TWELVE MONTHS BEFORE THE CLAIM. WITHOUT LIMITING §2 AND §3, WE HAVE NO LIABILITY FOR THE OUTCOME, ADEQUACY, OR REGULATORY ACCEPTANCE OF ANY INSPECTION OR REPORT.
9. Changes
We may update these Terms; material changes will be notified to workspace owners by email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
